Terms of Service

Last updated: 13 October 2026

These Terms of Service (the “Terms”) are a binding agreement between you and Private Entrepreneur Kolomiiets Viktor Mykolaiovych (“Beautica”, “we”, “us”), the operator of the Beautica platform and the websites at beautica.io and app.beautica.io. Please read them before you use the service.

1. Acceptance of these Terms

By creating an account, signing in, or otherwise using Beautica (the “Service”), you agree to these Terms and to our Privacy Policy. If you use the Service on behalf of a business, you confirm that you have authority to bind that business, and “you” includes it.
If you do not agree, do not use the Service.

2. What Beautica is

Beautica is a software platform for beauty, wellness and health service businesses. It includes online booking, calendar, team and service management, payments, reporting, and automated email and messaging notifications (the “Business Tools”), as well as a client-facing booking experience and marketplace.
Beautica provides software only. We are not a provider of beauty, medical, dental or wellness services, and we are not a party to any appointment or sale between a business and its clients.

3. Eligibility and accounts

You must be at least 18 years old, or the age of majority where you live, and able to form a binding contract. The Service is intended for businesses and their clients, not for children.
You can sign up with an email or through a third-party sign-in such as Google, Apple or Facebook. You agree to give accurate information, keep it current, keep your credentials secure, and tell us promptly at hello@beautica.io if you suspect unauthorised access. You are responsible for everything done under your account, including by team members you invite.
Business owners control the roles and permissions of administrators, specialists and other users in their account.

4. Business users

If you use the Business Tools, you are responsible for:
  • the accuracy of your services, prices, availability, locations and opening hours;
  • providing services to your clients and honouring appointments you accept;
  • holding every licence, registration, insurance and professional qualification your business needs, including for regulated dental and medical services;
  • your own cancellation, no-show and refund policies, and clearly showing them to clients;
  • complying with laws on consumer protection, taxes, employment, advertising and health and safety.
You are the controller of your clients’ personal data and we process it on your behalf. See the Privacy Policy. You are responsible for having a lawful basis, such as consent, to contact your clients, including through email and WhatsApp reminders and marketing.

5. Clients who book through Beautica

If you book an appointment, your contract for the service is with the business you book, not with us. The business sets its prices, availability and cancellation terms. Questions about a service, a refund, or a complaint about its quality should go to that business first.
We may share your booking details with the business so it can serve you, and we may send you confirmations and reminders about your appointments.

6. Plans, fees and payments

You can start for free, with no card required. Paid plans, their prices and what they include are shown on our pricing section. We will tell you about a price change before it takes effect, and it will not apply to a period you have already paid for.
Paid plans renew at the end of each billing period until you cancel. You can cancel at any time from your account; cancellation takes effect at the end of the current period, and unless the law requires otherwise, fees already paid are non-refundable. Fees do not include taxes, which we add where required.
Where the Service lets businesses take payments from clients, payments are processed by third-party payment providers under their own terms. We are not a bank or a payment institution and are not responsible for the provider’s acts. Any processing fees are shown before you enable payments.

7. Acceptable use

You agree not to:
  • break the law or infringe someone’s rights using the Service;
  • post false, misleading, defamatory, discriminatory or sexually explicit content, or fake reviews or bookings;
  • send spam or contact people without the consent the law requires;
  • upload malware, or probe, scan or test the Service for vulnerabilities without our written permission;
  • scrape, copy, resell or reverse engineer the Service, or use it to build a competing product, except as the law permits;
  • overload or disrupt the Service, or bypass limits and security measures;
  • impersonate another person or business, or share your account with people outside your business.
We may remove content and suspend or end accounts that break these rules or put others at risk.

8. Your content and our licence

You keep ownership of the content and data you put into the Service, such as business details, photos, service menus, client records and messages (“Your Content”). You give us a worldwide, non-exclusive licence to host, store, display, transmit and process Your Content only as needed to run, secure and improve the Service and to provide it to you.
You confirm that you have the rights needed to provide Your Content and that it does not violate the law or anyone’s rights. If you give us feedback or suggestions, we may use them freely without obligation to you.

9. Our intellectual property

The Service, including its software, design, text, graphics, logos and the Beautica name, belongs to us or our licensors and is protected by intellectual property laws. We grant you a limited, revocable, non-exclusive, non-transferable right to use the Service for its intended purpose while these Terms apply. No other rights are granted.
If you believe content on the Service infringes your rights, write to hello@beautica.io with enough detail for us to find and assess it.

10. Third-party services

The Service works with third-party services such as sign-in providers, payment providers, messaging channels like WhatsApp, calendars and hosting. Those services are governed by their own terms and privacy policies, and we are not responsible for them or for their availability.

11. Availability and changes

We work to keep the Service available and reliable, but we do not guarantee it will be uninterrupted or error-free. We may carry out maintenance, and we may add, change or remove features. If we make a change that materially reduces what you pay for, we will give you reasonable notice.
Automated reminders can be delayed or fail to deliver, for example because of a messaging provider or an incorrect phone number. Do not treat them as the only way to confirm an appointment.

12. Suspension and termination

You can stop using the Service and close your account at any time. We may suspend or terminate your access, with notice where reasonably possible, if you breach these Terms, if required by law, if payments remain unpaid, or if your use creates risk for us or others.
After termination, your right to use the Service ends. We will keep or delete Your Content as described in the Privacy Policy, and you may ask to export your data before your account is closed. Sections that by their nature should survive, including those on intellectual property, disclaimers, liability and governing law, will survive.

13. Disclaimers

To the maximum extent the law allows, the Service is provided “as is” and “as available”, without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose and non-infringement. We do not warrant the quality, safety or legality of services offered by businesses on Beautica, and we do not provide medical, legal, tax or financial advice.
Nothing in these Terms limits rights you have as a consumer under mandatory law that cannot be excluded.

14. Limitation of liability

To the maximum extent the law allows, we are not liable for indirect, incidental, special, consequential or punitive damages, or for loss of profits, revenue, data, goodwill or business opportunities, arising from or related to the Service.
Our total liability for any claim relating to the Service is limited to the greater of (a) the fees you paid us in the 12 months before the event giving rise to the claim, and (b) EUR 100. Nothing in these Terms excludes liability that cannot be excluded by law, such as for fraud, wilful misconduct, or death or personal injury caused by our negligence.

15. Indemnity

If you are a business user, you agree to defend and compensate us against third-party claims, losses and reasonable costs arising from Your Content, your services, your breach of these Terms or applicable law, or your messages to clients without the required consent. This does not apply to the extent the claim is caused by us.

16. Governing law and disputes

These Terms are governed by the laws of Ukraine, without regard to conflict-of-law rules. Please contact us first at hello@beautica.io and we will try in good faith to resolve any dispute informally.
If that fails, disputes are decided by the competent courts of Kyiv, Ukraine, unless mandatory law gives you the right to bring a claim in the courts of your home country, which these Terms do not take away. If you are a consumer in the EU or UK, you keep the protection of the mandatory consumer laws of your country of residence.

17. Changes to these Terms

We may update these Terms from time to time. If a change is material, we will notify you by email or inside the Service before it takes effect. Continuing to use the Service after the effective date means you accept the updated Terms. If you do not agree, stop using the Service.

18. General

These Terms and the Privacy Policy are the whole agreement between you and us about the Service. If a provision is found unenforceable, the rest stays in effect. Not enforcing a right is not a waiver of it. You may not assign these Terms without our consent; we may assign them as part of a merger, sale of assets or reorganisation. Notices to you may be sent to the email on your account.
